PRIVACY NOTICE ISSUED PURSUANT TO ARTICLE 13 OF EU REGULATION 2016/679 ON THE PROCESSING OF CUSTOMER/VISITOR PERSONAL DATA

The following data protection notice is designed to inform you about the processing of your personal data and your rights in relation to such processing under the General Data Protection Regulation (“GDPR”) and applicable local law.

We, the company QUARTIER AZUGA S.A. with registered office in Sat Chiajna, Comuna Chiajna, Intr. NICOLAE IORGA, Nr. 37D, cam. 2, County Ilfov (“QUARTIER AZUGA”), represent the controller in accordance with the GDPR and are therefore responsible for the data processing described below. 3. a) Registering and holding customer status

We will process the personal data indicated in the course of business transactions with you for the purpose of fulfilling our legal obligations as controller and for the purpose of concluding and performing the contract with you. During the course of the contract with you, your personal data are also processed for the purposes of: (a) issuing tax invoices (in accordance with the contract and the provisions of the Tax Code); (b) granting or applying the product guarantee where applicable; (c) recovering any amounts you may owe to QUARTIER AZUGA; (d) sending communications relating to the commercial transactions recorded (e.g. making payments); (e) other operations required by financial accounting rules (including archiving financial accounting documents) and any other legal provisions; (g) reporting to public institutions.

This processing is based on Art. 6 para. 1(b) and (c) of the GDPR (performance of a contract or steps taken at the request of the data subject prior to entering into a contract and fulfilling a legal obligation).

When you communicate with us via the contact forms on the QUARTIER AZUGA website (https://quartier-azuga.ro/contact/), when you contact us by telephone or when you send us communications by any other means, we process your data in order to respond to your requests. We will keep in touch with you through any of the available communication channels, depending on the contact details you send us. This processing is based on Art. 6 para. 1(f) of the GDPR (legitimate interest pursued by the controller). It is the legitimate interest of Quartier AZUGA to respond to your requests. If you request to exercise your rights under the GDPR, this processing is based on Art. 6 para. 1(c) of the GDPR (legal obligation).

1. b) Marketing and customer analysis

We will process your personal data that is collected through the customer registration form and the declaration of consent, as well as during future business transactions, also for marketing and customer analysis purposes (e.g. market research, opinion surveys, etc.). For the purposes mentioned above we will contact you: (a) both directly: face-to-face meetings with the legal entity’s representative, telephone, mail (mailing address of the legal entity) and (b) by electronic means: email, messaging (SMS and other digital platforms), social media, online advertising. etc. This processing of your personal data for marketing and customer analysis purposes will be based on and carried out on the basis of your prior consent (Art. 6 (1) (a) GDPR).

1. c) Data recipients

In order to achieve the above-mentioned purposes, we use service providers, i.e., service providers authorized under Article 28 GDPR, for example our IT service providers, hosting services, platform and maintenance services. These external service providers are located in countries within the European Union (EU) and the European Economic Area (EEA). No other transfers of personal data are made to other recipients unless we are legally obliged to do so. We may also be required to pass on your data to public authorities for the purpose of fulfilling a legal obligation.

1. d) Mandatory/voluntary provision of data and duration of data retention

Providing the following data is necessary to be able to conclude a contract with you: name, surname, home address, serial number and ID number, personal number/national ID, email address. The rest of the data collected in the customer registration process is provided by you on a voluntary basis (you are not obliged to provide us with this personal data and this data is not a legal or contractual requirement or a requirement necessary to conclude a contract. If you do not provide us with this personal data, this will have no consequences for you).

Duration of processing: QUARTIER AZUGA will keep your data for the period necessary to achieve the purposes mentioned above, for which personal data will be processed during the course of the contract with you, plus the general limitation period provided for by applicable law, namely 3 years. Also, after the termination of your customer status, in order to comply with the financial-accounting and tax legislation, it will be necessary to keep certain information for an additional period of 10 years and the data processed for the resolution of requests/suggestions/complaints/enforcement of rights will be processed for a period of 3 years after the resolution.

The time limits mentioned above may be extended in the event of litigation or other situations provided for by the legislation in force.

3. Processing of minors’ data

QUARTIER AZUGA does not knowingly contact or collect information from persons under the age of 18. The website is not intended to solicit information of any kind from persons under the age of 18.

If we come into possession of such information in error and are notified of it, we will obtain the appropriate parental consent to use the information or, if that is not possible, we will delete the information from our servers.

4. Your rights

As a data subject, you may contact our Data Protection Officer at any time and free of charge with a notification using the contact details mentioned in point 1. c) in order to exercise your rights under the GDPR.

These rights are as follows:

• The right to receive information on the processing of data and a copy of the data processed (right of access, Article 15 GDPR),
• The right to request rectification of inaccurate data or completion of incomplete data (right of access, Art. 16 GDPR),
• The right to request the deletion of personal data and, where personal data has been made public, the transmission of information about the deletion request to other controllers (right of erasure, Article 17 GDPR),
• The right to request restriction of data processing (right to restriction of processing, Article 18 GDPR),
• The right to receive personal data relating to the data subject in a structured, commonly used and machine-readable format and to request the transfer of such data to another controller (right to data portability, Article 20 GDPR),
• The right to object to the processing of data with the intention to stop processing (right to object, Article 21 GDPR),
• The right to withdraw at any time the consent given in order to stop a data processing based on your consent. The withdrawal will not affect the lawfulness of the processing based on the consent given before the withdrawal (right to withdraw consent, Article 7 GDPR).
• The right to lodge a complaint with a supervisory authority if you consider that the data processing is in breach of the GDPR (right to lodge a complaint with a supervisory authority, Article 77 GDPR).
